Exclusionary Rule Essay
The exclusionary rule is a legal procedure in the United States, which falls under the constitution. It protects citizens of the country in making sure that law enforcement officers are operating lawfully and that they abide by all search and seizure laws. It goes so far to protect the citizens of The United States that if a law enforcement officer illegally obtains evidence it can and most likely will be thrown out of the court. The purpose of this paper is to analyze the exclusionary rule, exploring its fallacies and importance while also including the history and evolution of the controversial exclusionary rule. The exclusionary rule is a very important legal principle in the United States and is crucial to keeping law enforcement and the judicial system in a fair balance with accordance to the United States Constitution. The exclusionary rule was never even thought about or existed until the early 20th century. Samaha (2012) states that before the exclusionary rule ever existed the only remedy for constitutional violations involving the exclusionary rule were private lawsuits. The framers of the constitution had it in their mind that judges would just handle each case as they see fitting to the nature of the situation. However this seemed not to work for quiteà some time as there was a police misunderstanding of the 4th and 5th amendments figuratively speaking. It wasnââ¬â¢t until 1914 when citizens of the United States began to receive their liberty back piece by piece. In the case of _Weeks v U.S.,_ federal officials raided his house in order to obtain evidence in a gambling case against Freemont Weeks. They had no warrant and no right to be in his house to seize anyà of his possessions. So Freemont appealed and he won, in a way. The Supreme Court ruled to give back his belongings. They did not return contraband and this rule only applied to the federal law enforcement. Which is why this is the first hint of a trend towards a prominent and well known exclusionary rule. There was many Judges and government officials who still refused to side with Justice Edward White in the case of Freemont Weeks. For example, in the case of _People v. Defore_ Judge Cardozo mad his opinion very well-known and famous. According to Kamisar (2003) in the _People v. Defore_ case Judge Cardozo boasts his opinion very loudly and clearly stating that he would not adopt the exclusionary rule within New York. Kamisar (2003) then goes on to quote Judge Cardozo: ââ¬Å"excluding illegally seized evidence was not the only effective way to enforce the Fourth Amendmentâ⬠. Cardozo was not the last Judge or Justice to disagree with the new trend. The next case to disagree with Cardozo and many other opposing Judges would have to be _Silverthorne Lumber Co. v. U.S._ (1920). Justice Department officers and a U.S. Marshall entered the lumber companyââ¬â¢s office and illegally obtained all of the companyââ¬â¢s documents. They then went on to make photo copies and subpoenaed the Silverthornes. When they refused to follow court orders they were taken into custody for contempt of court. Samaha (2012) states that ââ¬Å"According to Justice Oliver Wendell Holmes, the governmentââ¬â¢s search and seizure ââ¬Ëwas an outrage'â⬠. This case expanded the exclusionary rule introducing the Fruit of the Poisonous Tree Doctrine. This doctrine bans the use of evidence indirectly based on an illegal governmentà action. Even after multiple court cases ruled in favor of the exclusionary many state legislatures still were not in agreement with the [exclusionary] rule. Some legislatures found ways around the fourth amendment. In the case of _Coolidge v. New Hampshire_ New Hampshireââ¬â¢s legislature was challenged on their warrant issuing practices. According to Lynch (2000) New Hampshire law was very controversial in the manner of how warrants were issued. The warrant-issuing power was vested in the Justice of the Peace. Now judges must issue warrants; but in the past it was very prominent for Justices of the Peace to fulfill this duty. In New Hampshire they vested the Justice of the Peace within the executive branch of the government. In other words, according to Lynch (2000) the ââ¬Å"police officers had subverted the Fourth Amendment by issuing search warrants to themselvesâ⬠. The Supreme Court ruled that New Hampshireââ¬â¢s practices were unconstitutional because the executive branch was issuing warrants to themselves. This practice was very opposing to the idea of checks and balances. This court case was a very historical one in which ruled in application with the separation of powers doctrine. It also further supported the exclusionary rule. One of the biggest cases in the history of the United States and the biggest turning point for the exclusionary rule was in the case of _Mapp v. Ohio._ In this case officers forcibly entered Miss Mappââ¬â¢s home without a search warrant or consent and provided a false warrant. Before this case not all states adopted the exclusionary rule. In the dissent by Harlan, Frankfurter, and Whittaker (1961) they stated that the ââ¬Å"_Weeks_ exclusionary rule should also be enforced against the statesâ⬠. Lafave (2009) also touches on the case quoting the courts statements: ââ¬Å"[A]ll evidence obtained by searches and seizures in violation of the Constitution is, by that same authority, inadmissible in a state courtâ⬠. Estreicher, S. and Weick, D. P. (2010) make an extremely validà and important point; stressing that the exclusionary rule is ââ¬Å"constitutionally required because it was the ââ¬Ëonly effective available wayââ¬â¢ to enforce the constitutional guarantyâ⠬ . This case is so historically significant because of this ruling. Finally, nearly 50 years after the _Weeks_ case, the exclusionary rule applied to all states. Even though the rule applied to all states we still did not have every aspect of the rule covered. The ââ¬ËKnock and Announceââ¬â¢ rule was always under controversy as to if the exclusionary rule was applicable in such situations. It wasnââ¬â¢t until _Hudson v. Michigan_ when the courts clarified the issue. The police had a warrant to enter _Hudsonââ¬â¢s_ home and when they knocked and announced their presence they waited a mere three to five seconds before entering the premise. Hudson appealed stating his fourth amendment rights were violated because the officers did not follow ââ¬ËKnock and Announceââ¬â¢ procedures. His evidence was suppressed, but later the appeal was reversed by Michigan Court of Appeals. According to Justice Scalia the waiting period of the officers had no connection to the discovery of the illegal drugs and weapons. Because of this case the ââ¬ËKnock and Announce Ruleââ¬â¢ was clarified by stating that the rule did not have any interest in preventing the government from taking evidence described in a warrant. Tomkovicz (2008) believes that this case was intended to further the restrictions on the exclusionary rule. I have to agree with Tomkovicz in this statement. Gittins (2007) also makes a valid argument in concerning the argument. He [Gittins] states that during the night hours residents will have a longer period of time in which they will be able to open the door. However the courts have found that very short periods of time (five seconds) can be ââ¬Å"reasonable wait timesâ⬠. Courts are still in the process of clarifying the exclusionary rule; although _Hudson v. Michigan_ added some amount of clarity to the issue. Lastly, and the most recent court case concerning the exclusionary rule is _Herring v. U.S._ in which a recalled arrest warrant was executedà accidently. The Coffee County Sheriffââ¬â¢s Department were executing a warrant in which the county clerk found to be accurate. Upon arrest they soon learned the warrant was recalled some five months ago. Herring moved to suppress the evidence on the motion that his warrant was rescinded. Josephson (2009) states that the courts generally exclude the exclusionary rule when there are negligent errors amongst recordkeeping. The court denied Herringââ¬â¢s motion for suppression because of the Good Faith Clause established in _U.S. v. Leon._ This is a significant case because of how it furthered the interpretation of the exclusionary rule. Josephson (2009) explains how this case interpreted the exclusionary ruleââ¬â¢s main goal which is ââ¬Å"the deterrence of unconstitutional police conductâ⬠. Therefore by the police unknowingly executing what they thought to be an accurate warrant left the evidence applicable in courts. The exclusionary rule is intended to keep law enforcement and federal officials in check with the constitution. But often there is the controversial topic of whether or not the framers of the constitution intended for such a rule. The framers never had any motion to include an ââ¬Å"exclusionary ruleâ⬠into the fourth amendment. However, Geller (1975) makes an excellent observation stating that the framers didnââ¬â¢t provide any remedies for a violation of the fourth amendment. Which brings me to my next topic of the controversy. Because the framers left no remedies for violations of the fourth amendment, the courts were left to create the exclusionary rule to deter law enforcement from violating citizenââ¬â¢s rights. Many argueà that this does not effectively deter officers. Geller (1975) argues that there is no significant evidence to support such claims. Geller (1975) also comments on alternatives declaring that ââ¬Å"Until data [is] available concerning the effect of these alternatives, it is impossible to state with any degree of certainty that these alternatives are either more effective or less effective than the exclusionary rule.â⬠The last major issue I found in Gellerââ¬â¢s (1975) journal came from a group called Americans for Effective Law Enforcement (AELE). They seem to believe the exclusionary rule is no longer necessary due to the high degree of police professionalism. AELE believe police violations are unintentional and because of their high degree of professionalism they act in ââ¬Å"Good Faithâ⬠. Therefore petty mistakes allow evidence to be excluded and free criminals. Until there is a significant study that entails multiple well rounded solutions to the exclusionary rule; I do not see any possible alternatives. The exclusionary rule was created almost one hundred years ago. The rule will continue to be reformed and transformed as time goes on. Although there may be a substantial argument pertaining to the issue, we need the exclusionary rule. Undoubtedly the rule has an abundance of justifications compared to its fallacies. It was stated loud and clear by the framers some two hundred years ago what rights we as American people possess. The exclusionary rule is a major backbone of the judicial system of our country, it maintains the system of checks and balances keeping the American peopleââ¬â¢s rights prevalent and intact. The exclusionary rule is in working order, being reformed every day to protect our civil liberty and keep the integrity of our constitution set out by our own framers. Hezbullah: Impact of Ideology on Group Structure, Strategy, Targets and Tactics Essay
Hezbullah or Hezbollah, which literally means ââ¬Å"Party of Godâ⬠, is an organization based on Lebanon. It is a religious-political-paramilitary organization of several thousand Shiite Muslim militants that plays a significant role in the Lebanese politics. Hezbullah, while maintaining to be a major contributor to social programs and services in Lebanon, has been considered an Islamic struggle movement. The group also is a foremost provider of agricultural services, medical aid, and school operations in Lebanon. The group is also a significant and influential power when it comes to the world of Lebanese politics. With its outright mission, to destroy Israel, it has been condemned by many governments ââ¬â but others have praised the party. Western countries, most notably the United States, consider Hezbullah as a terrorist organization. Other countries that recognize in some part or in whole the group as a terrorist organization include the Great Britain, Australia, Canada and several others. Origins It was in the year 1982 that Hezbullah surfaced in Lebanon as it was invaded by Israel and was dubbed as ââ¬Å"Operation Peace for Galileeâ⬠. Hezbullah was set in resistance against the Israeli occupation of Lebanon amid the Lebanese civil war. Inspired by the great Iranian political and religious leader, Ayatollah Khomeini, the leaders went for the training and organization of some Iranian Revolutionary Guards. Although the first manifesto of the group did not directly mention the destruction of Israel, the leaders of Hezbullah made several claims on destroying the ââ¬Å"Zionist entityâ⬠forcing themselves to the lands rightful owners own. They referred to the Israeli invasion of Lebanon that during the course, claimed not only livestock, lands, homes, but more especially lives. The group started only as a small militia but slowly gained followers that agree to the views and ideologies of the left-leaning group. They started to gain social power, as getting seats in the Lebanese government, being able to create social development programs, as well as getting control and owning their own radio station and a satellite television station. As Shiite Muslims account for majority of its members, their members now vary from all domain of Lebanese population, especially after the 2006 Lebanon war or the July war that featured the warfare between Israel and Hezbullah themselves. Given their broad tally sheets of members, they are able to mobilize protests to the hundreds of thousands of their members, creating a major concern for the Lebanese government itself. Objectives The 1985 manifesto of the Hezbullah enumerated their three main goals as follows: (1) to put an end to any ââ¬Å"colonialist entityâ⬠that existed in Lebanon, (2) to bring the Phalangists, a right-wing party in Lebanon, to justice for the ââ¬Å"crimesâ⬠they had perpetrated, and finally (3) to the rightful establishment of an Islamic regime in Lebanon. The manifesto also featured some of the ideologies of the group. The group condemns the ââ¬Å"Zionist occupation of Palestineâ⬠outright and added by several claims that ââ¬Å"there is no legitimacy for the existence of ââ¬ËIsraelââ¬â¢Ã¢â¬ . The Ideology of Hezbullah is derived from the Islamic Shiite Ideology popularized by Ayatollah Khomeini, known for leading the Islamic revolution in Iran in the 1970ââ¬â¢s. The Founding Statement of Hezbullah contains a section that reads: ââ¬Å"We see in Israel the vanguard of the United States in our Islamic world. It is the hated enemy that must be fought until the hated ones get what they deserve. Our primary assumption in our fight against Israel states that the Zionist entity is aggressive from its inception, built on lands wrested from their owners, at the expense of the rights of the Muslim people. Therefore our struggle will end only when this entity is obliterated. We recognize no treaty with it, no cease fire, and no peace agreements, whether separate or consolidated. We vigorously condemn all plans for negotiation with Israel, and regard all negotiators as enemies, for the reason that such negotiation is nothing but the recognition of the legitimacy of the Zionist occupation of Palestine.â⬠It was entitled ââ¬Å"The Necessity for the Destruction of Israelâ⬠which pretty much sums it all up. Structure From 1992 up to the present, the organization has been headed its Secretary-General, Hassan Nasrallah. Originally a military commander, but with the background of studying Shiite theology in Iran and Iraq, Nasrallah made it higher in the ranks with ease. Some reports suggest that he took advantage of the inside rivalry in the group to capture the Secretary-General position from Ayatollah Ruhollah Musavi Khomeini. Another leader, Sheikh Mohammed Hussein Fadlallah, has been the groupââ¬â¢s spiritual leader since its founding. However, Fadlallah, died of a liver hemorrhage recently, 4th July 2010, at the age of 75. There is still a huge blank space to be filled in the groupââ¬â¢s spiritual leaderââ¬â¢s death. One other leader can be considered as the brains of the Hezbullah operations worldwide. It was Imad Fayez Mugniyah who was considered as the key planner, the mastermind, the engineer that finds time to plan details and execution of its terrorist operations. Mugniyah got his talent from experience, training with al Fatah in the 1970ââ¬â¢s in the midst of the Lebanese civil war. It was in the 1980ââ¬â¢s that the two, al Fatah and Mugniyah, were expelled from Lebanon by Israeli forces. But with his talent and skill, he quickly went up ranks after joining the Hezbullah. However, it was on 13 February, 2008, that Mugniyah was killed in a car bombing incident in Damascus supposedly pinned to Israel but with no solid grounds. The group is structured into three sub-groups namely the Bayt al-Mal, Jihad al Binna and the IRSO (Islamic Resistance Support Organization). Hezbullah gets its finances from support from various governments, Iran, Tehran and Syria, as well as donations from the Lebanese people and both local and international Shiites. With the current finances, the influence and the power both as a group and in the government, its forces gained momentum as gaining several thousands in members. The Lebanese government itself secured Hezbullahââ¬â¢s existence with policies that allow the group to continue on in their fight for liberty and recover occupied lands. According to data from the United States, the two states, Iran and Syria, contribute to not only the finance, but also to the training, weapons, explosive, diplomatic and political aid of the group. Hezbullah is believed to have a budget ranging from $200 million to $500 million, about $100 million coming from Iran. Operations Hezbullahââ¬â¢s main base for operation is in the Lebanonââ¬â¢s Shiite-populated areas. This includes Beirut, Bekaa Valley and southern parts of Lebanon. But with recent intelligence reports from the U. S.à suggest that the group has been starting its expansion of operations, from Africa to Europe, South America and even in North America. The group has at least five thousand core members, consisting of militants and activists. But it varies notably from time to time due to conflicts that the group engages in, most probably conflicts with Israel. US intelligence also reports the presence of at least 60,000 firearms and other weapons in the hands of Hezbullah. It includes both short and long range rockets, and even anti-tank, anti-aircraft and anti-ship arsenals. With periodic conflicts with Israel, people are concerned that a third Lebanon war may erupt if tensions remain high. Although Israel has officially withdrawn from Lebanon in 2000, and despite the UN certification of the withdrawal of all forces, Hezbullah still periodically create problems in the disputed Shebaa Frams border zone. Consequently, a full scale war erupted during the summer of 2006 and if it werenââ¬â¢t for a UN-led-ceasefire, it probably wouldnââ¬â¢t have stopped any time soon. Even so, it stopped only after taking more than a thousand lives and hundreds of thousands homeless or forced to flee especially the five-week long conflict. Some major attacks attributed to Hezbullah includes the kidnapping of several Americans in Lebanon during the 1980ââ¬â¢s; suicide attacks in a U. S. Marines barracks in Beirut, Lebanon which kills over two hundred American soldiers; the 1983 U. S. Embassy bombing in Beirut that killed 63 people, including 17 Americans; the French multinational force headquarters bombing in 1983 that killed 58 French soldiers; the hijacking of TWA flight 847 that featured in an infamous footage of a pilot with a gun to his head; an attack that killed hundreds in the Israeli embassy and a Jewish community center both in Argentina in 1992 and 1994 respectively. The most recent major attack claimed by the Hezbullah was on 2006 when they launched a surprise raid on a border post in northern Israel. They took two Israeli soldiers in captive that caused an intense military campaign to be forced against Lebanon. But there was more to the campaign of the Hezbullah. By 2003, they have worked diligently with other Palestinian terrorist organizations such as Hamas, Islamic Jihan, and the Popular Front for the Liberation of Palestine, and especially Tanzim. It has also been reported that Hezbullah has been a major firearms supplier with their allies as in the Hamas. Analysis It has been with mixed decisions whether Hezbullah is to be considered as a terrorist organization or not. It is a known fact that some countries do not consider the group as a terrorist organization in whole. The United States however, has issued statements against the group, considering them to be a highly-organized terrorist organization. To be able to analyze the group itself, there is a need to answer this question: Should the Hezbullah be considered as a terrorist organization? For the sake of unbiased perspective, we must consider all perspectives. In the Hezbullah perspective arguments include that fact that (1) the main ideology of the group is based on Islamic ideologies, only more radical ones, (2) every country has the right to protect and maintain its liberty in ways it can, and finally (3) the group is actually a part of the Lebanese government. But then again, nothing gives the right for any person, group and even a country to declare that a country has no reason to exist and that the country and its people should be obliterated. By this argument plus the known attacks that they have committed and claimed for, it can be concluded that the group can be considered as a terrorist organization. After setting the fact that Hezbullah is a terrorist organization, an analysis can be put in this perspective. From its origin standpoint, the group can be considered outright to be a radical and extremist in thoughts and in action. It is based from their ideological background that was actually derived from a radical form of Islamic Shiite Ideology that Khomeini had started. Its aim, more than anything else, is to destroy the country of Israel and its occupants, and kill the Jews. The structure of the group can be considered to be a help in their aims and objectives. Considering the separate leadership roles in the group, namely the political, religious and military roles, there are good opportunities to focus to their separate roles. There is a much efficient set of directives that would be of help to the members of the group. But there also is a backfire, if there are any occasions that the three leaders would disagree, the whole group could turn into a separate sub groups, reducing considerably the ability to achieve the objectives of the group. Considering the strategies of the organization, it could be noted that this is interwoven with the organizations structure. The military strategies of the group should coincide with both the religious and political perspective of the group, and vice versa. With the strategy of the organization to attaining its aims, they will be bounded by international policies only if they want to. Their tactics to complete their objectives can be considered to have lessened in the amount of violence that they have made in the older movements. Whether it could be accountable for the tighter defense being pushed by their opposition, i. e. U. S. , Israel, or to internal erosion with the groupââ¬â¢s desire to succeed, will be a question to be answered in the future. Their targets remained the same, the ââ¬Å"Zionist entityâ⬠that they refer to Israel, added to the ââ¬Å"vanguardâ⬠of Israel, the United States. But the question mark lies in the present execution of their objectives, whether they will take it hard, as in violence that includes the public, or will they use a more reasonable action. The group structure and strategies very much meet their deed to accomplish its task. They may be planning to be more of a supporting group to other terrorist organization with the way they are moving as of the moment. They have no other engagement as of the moment. A possible scenario could be that the group would slowly blend to other terrorist organizations and would create a larger one, with a bigger objective than the original. They may consider to continue on supplying and supporting groups such as Hamas, to help them achieve their ultimate goal.

By Roadways: Drive from Bangalore to Mysore and then take the Mysore-Ooty highway via Nanjangud and Gundlupet from where the park is just a half an hour drive.

A few years back, Paulina was kidnapped and brutally raped and tortured while blindfolded, by a sadistic doctor who played Franz Schubert's quartet "Death And The Maiden." She believes that the stranger that her husband has now brought into their home is the doctor responsible for her traumatic experience. She imprisons the doctor, extracts a forced confession from him and yet, instead of killing him, lets him go in the end. The play provides the reader with ample chances to look inside the tortured soul of Paulina and understand the extent to which her personality has been distorted by her past experiences. Paulina insists fiercely that the prisoner be put on trial and adamantly refuses to hear the moderate voice of her husband, showing that she has lost all rationality and reason and is blinded by a terrible rage. By depicting this, Dorfman has shown how thirst for revenge remains dormant, hiding beneath the layers of a victim's, in this case Paulina's, personality creating an illusion of normalcy, lulling the victim's loved ones into a false sense of complacency. However, when Paulina is shown to be reliving a traumatic experience from her past, her hatred resurfaces again with such violence that it shocks. When Paulina binds the doctor to a chair, she gags him using her panties. This action of hers is highly insightful as it shows that the doctor's total degradation is her main aim and nothing else, and only the most humiliating treatment meted out to her prisoner will satisfy her. She does this because unconsciously she desires the doctor to go through the same mental and emotional torment that she went through. Seeing him helpless, physically bound and gagged, writhing in agony and even unable to feed himself, gives her a deep, perverse satisfaction. Keeping her secret activities against the fascist regime of her country and her courage during her captivity in view, we can safely to assume that Paulina is a decent human being with a high moral sense and belief in lofty ideals such as freedom and justice, but when it comes to Dr. Roberto Miranda, she remorselessly throws all those ideals to the wind and becomes a tigress, thirsty for blood. Dorfman effectively highlights the inner turmoil of Paulina's soul by juxtaposing her tormented psyche with physical proof of how much she suffers. Why the Legal Drinking Age Shouldnt be lowered Essay In the United States, the legal drinking age for all fifty states and the District of Columbia is twenty-one. The drinking age is twenty-one because the government decided this is when a person becomes legally responsible to handle the repercussions of consuming alcohol. The U.S. has the highest legal drinking age in the world. Only four countries in the world have a legal drinking age over eighteen, making the US an exception rather than the rule. Some people may argue that the government should lower the drinking age since you legally become an adult at age eighteen, but I completely understand this law and am totally for it. Underage drinking has become an epidemic that has spread all over the world, but more so in the United States than any other country. This is disturbing because the brain is not fully developed until a person is around twenty-two years of age. Therefore, it should be harder for minors to obtain alcohol, and the legal drinking age should not be lowered. What is alcohol, and where did it come from? Alcohol is a natural substance formed by the reaction of fermenting sugar with yeast. The production of alcohol started about 10,000 years ago. It all started around the Black and Caspian Seas with wine, and slowly made its way around the surrounding areas. Mesopotamia and Egypt were thriving with wine productions by 3,000 B.C. (Narconon). A thousand years later, a Roman God, Dionysus, started appearing in the literature, and was the god of the grape harvest. Then, about 700 years after that, in addition to wine, India started manufacturing beer. This new production spread rapidly, and the Hebrews adopted the new beverage for many different new medicines. After that, the Jews began to use wine and beer in sacred rituals and ceremonies. Although some cultures accepted alcohol, others rejected it completely. Because these alcoholic beverages were spreading so quickly, they raised curiosity. A medical school in Italy began doing experiments, and finally developed something called distillation- a purer, stronger alcohol (Narconon). From Italy, these new drinks spread to England and Scotland, and eventually found their way over to America. Drunkenness became a huge problem in America, so the government passed the Prohibition Act of 1920. Originally, the eighteenth amendment to the U.S. Constitution prohibited the manufacture, sale, transport, import, or export of all alcoholic beverages. Upon its ratification by the states, Congress voted its approval in 1919. Thus the law was passed, and became known as the National Prohibition Act of 1920 (American Medical Association). The eighteenth amendment was repealed in 1933, which made the Prohibition Act null and unenforceable. After prohibition, most states restricted the minimum legal drinking age to twenty-one. Between 1970 and 1975, twenty-nine states lowered the minimum legal drinking age to eighteen, nineteen, or twenty. These changes were made when other activities, such as voting, were lowered. In between September 1976 and January 1983, the minimum legal drinking age for every state was set at the age of twenty-one. Although this is the law in our country, it is also incredibly easy for minors to obtain alcohol. As always, there are different ways to work around the law. These are issues that must be addressed. Some of these ways include a fake I.D., a minor giving someone money to go buy it for them, going somewhere that will sell to minors, or even stealing it from their parents liquor cabinet. A fake I.D is fairly cheap and also easy to get if you know the right people. For the most part, if you were a minor trying to get alcohol you could go up to any random person, and eight times out of ten that person would go buy it for you. There are also places minors could go to buy it themselves like little gas stations around the lower socioeconomic societies. The reason that these gas stations will sell to minors is because it increases their sales, and because they will get little penalty for selling to minors. If they do get fined for it, the fine isnââ¬â¢t enough to make them stop. Alcohol generally is not secured in most homes so there is easy access for minors who have no fears about taking it from their parents. There has also been the increasing trend of parents not only providing alcohol, but encouraging its use in the home, under the assumption that minors will do it anyway and itââ¬â¢s better to do so in a supervised, safe environment. Underage drinking is one of the biggest problems that the U.S. faces, and is now considered a public health problem. Young adults have the highest prevalence of alcohol consumption than any other age group (Century Council). They also drink more heavily, experience more negative consequences, and engage in more harmful activities. Drinking at any age can have some of the worst effects on you and the people around you. Many young teens that experiment with alcohol believe there are no consequences to their actions. It is actually quite the opposite. Alcohol is associated with driving under the influence, violenceà and aggressiveness, sexual activity, smoking, and poor school performance. There are all of these problems, and then some that all started with alcohol. Driving under the influence or a DUI is classified under two categories, and can be given out if the person is under the influence of an intoxicating drink or a combination of an alcoholic beverage and drugs. There are felonies and misdemeanors. The difference between a misdemeanor and a felony is misdemeanor DUI charges means that the charge involved no injury or property damage, and the penalty can be up to 6 months in jail. A felony has injury and/or property damage, and the penalty could be up to three years in a state prison. This number fluctuates depending on the number of misdemeanors or felonies a person has had in the past. These laws are in place to not only protect the youth in America, but to also ensure that other innocent people on the roads do not get hurt. There are plenty of accidents that come from texting and driving already (which is the equivalent to drinking and driving) that to lower the drinking age, I think, would cause more alcohol-induced accidents. Underage drinking already contributes to more than 4,700 automobile wrecks a year (Centers for Disease Control and Prevention), and studies have shown that every twenty-two minutes someone will die of an alcohol related traffic accident (First Eagle Insurance Services). Although you probably think that it could never happen to you, other studies have shown that everyone has a forty percent chance of being in an accident involving alcohol use at some point in their life (Drug Free World). ââ¬Å"Vehicle crashes remain the leading cause of death for minors age 15-20 years oldâ⬠(Century Council). Aside from drinking and driving, there is also a two-way association between alcohol consumption and violence or aggressiveness. While individual behavior is shaped in large part by the environment, it is also manipulated by biological factors, and ultimately directed by the brain, but the brain is affected if large amounts of alcohol are consumed. The consumption of alcohol may promote aggressiveness and lead to victimization, which in turn leads to excessive consumption of alcohol. Violence and aggressive behaviors are those that are threatening, hostile, or damaging in a physical or nonphysical way. There have been multiple studies conducted that show there is a link between violent crimes and alcohol consumption. In 2012, the percentages of violent offenders who were drinking at the time of the offense were: ââ¬Å"eighty-six percent of homicideà offenders, thirty-seven percent of assault offenders, sixty percent of sexual offenders, up to fifty-seven percent of men, and twenty-seven percent of women involved in marital violence, and thirteen percent of child abusersâ⬠(NIAAA). A lot of times alcohol is accompanied by cigarettes, marijuana, or other hardcore drugs. Many researchers hypothesize that the ethanol in alcohol triggers a feeling of pleasure, and those feelings are reinforced when nicotine is added to the mix. Others think that those who abuse one substance will be more inclined to abuse other substances. Nicotine lowers blood alcohol concentration, so therefore a person who is smoking and drinking simultaneously would have to consume more alcohol in order to reach intoxication. Most people react differently to alcohol than others do. A lot of this has to do with the personââ¬â¢s age, gender, race/ethnicity, physical condition (weight, fitness level etc.), amount of food consumed before drinking, use of drugs/prescription medications, and family history of alcohol problems. Usually when there is a family history of alcohol problems you will often see a history of some other type of disease linked to it. Some of these include: breast cancer, oral cancer, heart disease, strokes, diabetes, and cirrhosis of the liver. Twenty percent of alcohol is absorbed directly through the stomach walls into the bloodstream, and reaches all organs and tissues of the body within moments. The other eighty percent is processed through the gastrointestinal system. It is considered a drug, and is a sedative depressant of the central nervous system (Reeves). Alcohol can damage the dendrites at the end of a nerve cell causing disorder to brain functions. It is also capable of rupturing blood capillaries and veins. Aside from damaging nerves and veins, it can also damage the liver. It stops the liverââ¬â¢s ability to process fats, and can cause disease. The high sugar content in some alcoholic or mixed beverages can lead to hypoglycemia and predispose one to diabetes. Alcohol can also alter sleep patterns, basic motor functions, thoughts, and emotions. The consumption of alcohol on or at an above average rate can lead to alcoholism. Women metabolize alcohol more slowly than men. Because it stays in a womans bloodstream longer, it can cause more cellular damage of the kind that can trigger cancer. Alcohol also influences blood levels of estrogen and other hormones in ways that may make cancer more likely. For example, ââ¬Å"compared to women who dont drink at all, women who have threeà alcoholic drinks per week have a 15% higher risk of breast cancer. Experts estimate that the risk of breast cancer goes up another 10% for each additional drink women regularly have each day. Girls ages 9-15 who have 3-5 drinks a week have 3 times the risk of developing benign breast lumpsâ⬠(Breastcancer.org). These benign breast lumps can be a precursor to breast cancer. From this it is easy to see that the younger that someone starts consuming alcohol, the increased risk of cancer and loss of life is more likely. It might be easy to dismiss this issue as one of personal choice or preference. This discounts the social impact of drinking on society. ââ¬Å"Alcohol costs American employers an estimated $134 billion in productivity losses, mostly due to missed workâ⬠(Ensuring solutions.org). The impact is not only economical though. Missed work impacts every worker at a job who must work that much harder to accomplish their work tasks. As a rule, workers in America pay taxes on their pay as part of the social contract. High school and college dropouts on average earn less thanà those with secondary and post secondary degrees. There are also legal fees for DUIs or Public Intoxication citations, plus bar tabs prior to the cessation of drinking. ââ¬Å"Out of every $100 American consumers spend, about $1 goes to alcoholâ⬠(Vo). The average household income is around $50,000 per year, meaning that on average $500 a year is spent on alcohol, for an approximate lifetime average of $35,000. ââ¬Å"In 2007 the death toll from teen drunk driving accidents was 1,393â⬠(Drug Free World). The economic impact of funeral expenses, which on average total around $6,000, is nothing in terms of emotional cost. Many parents who lose a child end up divorcing, tearing apart families in the process. This may also lead to alcohol or other drug abuse in the parents or siblings, resulting in further economic, social, and societal impacts. Itââ¬â¢s a vicious cycle and one that could be avoided by continuing to keep the drinking age at the current level. There are numerous warning signs that a minor may have an issue with underage drinking and it is important for those involved in the minorââ¬â¢s life to recognize these to curb an issue before it begins. These include physical, emotional, family, school, and social problems. Parents, teachers, and friends should look for physical signs such as fatigue, red and glazed eyes, or a lasting cough. Emotional indicators include personality changes, sudden mood changes, irritability, irresponsible behavior, low self esteem, poor judgment, and depression. The minor may start more arguments, break more rules and withdraw from their family. There will be a decreased interest in school, drop in grades, increased absences, truancy, and a rise in discipline issues. The minor may show a big social change, with new friends, a change in style of dress, and possible problems with the law. This list is not exhaustive, but from the examples given it shows that underage drinkers have a wealth of issues that will affect them negatively for quite some time. With all of this in mind, I do not feel that lowering the legal drinking age would be in our countyââ¬â¢s best interest. The government has these laws in place to keep our country and the people in it safe, and if these laws were to change it would send our country into a downward spiral. I feel that the rates of alcohol induced traffic accidents, rates of violent crimes related to alcohol, rates of certain types of diseases, and much more would upsurge drastically. I also feel that if our government doesnââ¬â¢t address these issues with more force and power, minors will keep doing what they have been doing and nothing will change. Despite all of this success Wal-Mart still has a huge opportunity to grow. Wal-Mart has generated a huge market of loyal buyers by supplying them with the lowest possible prices for quality products. With Wal-Mart having such a huge share of the market and good prices there is no need for buyers to seek deals elsewhere. Symbolical Language in Their Eyes Were Watching God and The Great Gatsby In some novels, strong impressions are exploited to conceal other meanings. Unraveling these symbolic word puzzles may reveal insights into the author's perspective and one's own secrets.Ã A careful analysis of selected passages of two books: Zora Neale Hurston's Their Eyes Were Watching God and Francis Scott Fitzgerald's The Great Gatsby, will show that symbolical language can reveal even more insight. In this comparison, symbolism in the passages containing variations of the words "blossom" or "blooming" will be examined to reveal human development beyond sexuality and anatomy. The protagonist, Janie, in Hurston's Their Eyes Were Watching God, was sixteen years old when a series of natural events led to her to unlocking the secrets of her own sexuality. "Janie had spent most of the day under a blossoming pear tree in the back yard" introduces a location suitable for observing a miracle of reproduction in nature. The word "blossoming" indicates the narrator's comments are in the active present tense. The next few sentences, changing to past tense, reveal that this particular day--the third day--was much different than the first two. "That was to say, ever since the first tiny bloom had opened." The author poetically reveals progressive stages of pear tree flowers "blooming" along with their pollination by bees. This process so intensely intrigues Janie that her enhanced awareness triggers previously hidden sensual emotions and desires. Janie's continuous observation of the interplay among the plant and insect kingdom--mixed with her own intuitive feelings while lying on her back beneath the pear tree--leads her to a burst of in... ...prevent Gatsby from relating to other "nice" girls like Daisy (148). In other words, both Janie and Gatsby had stumbled into a new awareness because of major turning points in their lives, but these were just beginnings! They had graduated from being "grown up children," but now they were like "children at being adults" still having much to learn. The remaining story developments of both books detail further growth in the character development of the protagonists and the principle characters. And so it is with us and how we unravel the mysteries of symbolism in literary word puzzles, that we as readers can also grow like "blossoms blooming" through the eyes of Hurston and Fitzgerald. Throughout Cobainââ¬â¢s childhood he was a sickly child, suffering from bronchitis, the divorce of his parents and was living in a ââ¬Å"depressed and dying lodging townâ⬠(Ronson, 1996). At the age of ten Cobain suffered because of loss of security and the constant moving between homes due to his parentsââ¬â¢ divorce. (Soylent Communications, 2010) His parents were mostly absent because they were working-class people; Cobain was the ââ¬Å"son of a mechanic and a waitress.â⬠(Soylent Communications, 2010) Growing up the child of working-class people really put Cobain in a place where he was deprived of many things and was left fulfill his own needs, emotionally and physically. Cobain found friendship in Krist Novoselic, who had similar dreams and interests in punk music. (Soylent Communications, 2010) The depressing lodging town of Aberdeen, Washington left Cobain with nothing but scars from the repeated cases of abuse he received by the kids of his school, Cobain d ropped out of high school to pursue his dreams in his bands. Aberdeen was a dying town and nothing new was ever going on there. Cobain however did get his brea... ... be shown that we care about him and want to provide stability in his life. Itââ¬â¢s importance for a therapist to share things about themselves and give their honest opinion in order to make the patient comfortable and trusting of them. (Comer, 2011, p. 43) I believe that although this would just the start of his therapy there may be a need for drugs later on if the free association doesnââ¬â¢t work, although he would have prescription drugs in rehabilitation to aid him in the process of becoming permanently clean without the painful side effects of coming off of the drug. The therapy in the beginning is a necessity in getting to the later stages of treatment, the free associating therapy would be the largest part of his recovery and it would work quite well. I can see that this therapy would give him what he never had in life, stability.

Computers in Education The typical school has 1 computer per 20 students, a ratio that computer educators feel is still not high enough to affect classroom learning as much as books and classroom conversation. In effect, a satellite serves as a tall microwave tower to permit direct transmission between stations, but it can interconnect any number of stations that are included within the antenna beams of the satellite rather than simply the two ends of the microwave link. Computer Crime Computer crime is defined as any crime involving a computer accomplished through the use or knowledge of computer technology. Computers are objects of crime when they or their contents are damaged, as when terrorists attack computer centres with explosives or gasoline, or when a "computer virus" a program capable of altering or erasing computer memory is introduced into a computer system. Personal Computer A personal computer is a computer that is based on a microprocessor, a small semiconductor chip that performs the operations of a c.p.u. Personal computers are single-user machines, whereas larger computers generally have multiple users. Personal computers have many uses such as: Word processing, communicating to other computers over a phone line using a modem,databases,leisure games are just some of the uses of a Personal Computer. Computers for Leisure Games As they proliferated, video games gained colour and complexity and adopted the basic theme that most of them still exhibit: the violent annihilation of an enemy by means of one's skill at moving a lever or pushing a button. Many of the games played on home computers are more or less identical with those in video arcades. Increasingly, however, computer games are becoming more sophisticated, more difficult, and no longer dependent on elapsed time a few computer games go on for many hours.

CU1520: PROMOTE CHILD AND YOUNG PERSON DEVELOPMENT. 1. 1 Explain the factors that need to be taken into account when assessing development. When assessing a child you must be careful to take into account confidentiality before carrying out an observation you must have parents and the settings permission and not to leave confidential material lying around they must be secured in a locked cabinet. Only talk to authorized personal about confidential material. This confidentially can only be broken when a child is at real risk.When carrying out observations you must take account of the childââ¬â¢s wishes and feelings if a child is upset or wants you to stop then you must stop. Ethnic, cultural and linguistic backgrounds when we asses a child we must take account of their ethnic, cultural and linguistic back ground as these can play important roles in how the children acts and the understanding of the words being used. Disability or specific requirements need to be taken in account whe n carrying out any assessment /observation or a child can be underestimated and the observation will be unreliable. With observation we must understand the limitations of each type of observation method. Avoiding bias when observing children we must remain completely objective also having 2 people observing the child at the same time can produce a more accurate account. 1. 3 Explain the selection of the assessment methods used. There are various methods used to assess a childââ¬â¢s development. Free description- this is to record the behaviour of a child over a very short period of time. The observer notes down what he or she is seeing. This is a good method for looking at several areas of development. Advantage: observer can be unobtrusive and record children without them being aware. Itââ¬â¢s a flexible method allowing the observer to car ry out frequent observation. Dis advantage: observer can show bias and find it hard to record every thing a child says or do * Checklists and tick charts-Here specific activities are looked for either during a structured assessment or by observing children over a period of time.Advantage: observer is focused on developmental skills to be observed and so less biased. Disadvantage: observer may not record childââ¬â¢s attitude or how they socialise. The observer might alter the childââ¬â¢s performance once they know they are being observed. * Time sample- this method is used to look at childrenââ¬â¢s activity over a predetermined length of time. Advantage: the observer can see what a child is doing over a period of time and pick up on many different areas of development, attitudes, friendship and confidence.Disadvantage: interesting behaviours might fall of the sample time and open method of recording may allow for observer bias. * Event sample- this looks at the frequency at which an aspect of development or behaviour is performed. It is recorded in a prepared sheet. For example how often the child talks with adults or other children. Advantages: the observer focuses on one thing. Disadvantage: it does not explain why the child shows the type of behaviour. * Target child- this is used to record one childââ¬â¢s activity over a long period without any gap in the recording process.It gives information about several areas of development. Advantage: observer gains overall picture of what the child is doing. Disadvantage: The observer may not choose the period of time the child is showing their usual behaviour. * Standardised tests-used on older children to consider their skills in literacy, maths and over all cognitive development. Advantage: The observer bias is less. Disadvantage: children know they are being tested hence they do not show usual behaviour. They would have rehearsed and may show better performance. Filming- this provides you information a bout several areas of development. And you are able to watch it over again to see if you missed anything unlike the paperwork. More information is gained. Disadvantage: observer chooses what to record and the child is aware he is being recorded and this may change their usual behaviour. * Information from parents and colleagues- parents and colleagues see children in different situations and so may have a different view of the childââ¬â¢s development. However they may show observer bias. Any plan that involves supporting an individual should be focused on their needs and interest and wherever possible the children should be involved in the planning process. A child centred planning takes into consideration what is best for the child as well as how it might engage and involve the child. It is also important in planning that a child is not segregated from others but consider ways in which other children can become involved in the activity too.CU1520 PROMOTE CHILD AND YOUNG PERSON DEVELOPMENT 3. 1 Explain the features of an environment or service that promotes the development of children and young people. The physical and emotional environment that we create for children has a huge impact on their development. Features to consider while planning the environment includes the following. * Stimulating and attractive: the environment for the children must be interesting and visually attractive. * Well planned and organised: Working with children requires great organisational abilities because every child will have their needs, interest and personality.To accommodate this early years setting have to plan effectively and everyone within the setting needs to be organised. * Personalised and inclusive: it is required that early years settings to personalise the activities and play opportunities for children in ways that are inclusive. * Regulatory requirement met: all settings must meet the requirement of legislation. This will include compliance with the statutory framework of EYFS, health and safety legislation and also other legislation involving the safeguarding of children and their right. Varied environment: the setting should be varied in the provision to as to maintain the childrenââ¬â¢s interest. * High quality policies in place and followed: the need for policies and procedures follows on from the need of settings to follow legislative requirements. Policies must be reviewed, updated and evaluated to check for effectiveness. 4. 1 Explain how own working practice can affect children and young peopleââ¬â¢s development. * The adults in my own setting are aware of the development needs of the child. Activities are specifically planned to support every childââ¬â¢s development. * There is always a balance of activity to engage childrenââ¬â¢s interest. * Th ere is a balance between child initiated and adult initiated activities. * The balance of activity covers each of the aspects of learning in the curriculum and also builds on each of the developmental areas. * It is ensured that the adults have sufficient time to work with individual or small groups of children * All the children were engaged or participated during part or all of the sessions. 4. 2Explain how institutions, agencies and services can affect children and young peopleââ¬â¢s development. Children in their early years may have a range of needs and the way that practitioners work together can have a positive impact on their health, development and learning. Once parents/carers involved with the child have identified that a child needs additional support, a multi agency approach may be used. The parents visit the GP who makes the appropriate referral. Once they have ruled out the hearing or visual impairments, the GP may refer directly to the speech and language service. Once it is established what type of support a child requires, a collaborative approach is required in order that all professional, the parent and the setting work together. CU1520 PROMOTE CHILD AND YOUNG PERSON DEVELOPMENT 5. 2 Evaluate different approaches to supporting positive behaviour There are many different strategies and approaches when it comes to supporting childrenââ¬â¢s behaviour. Below is some of positive behaviour support. * Least restrictive principle * Reinforcing positive behaviour. This is about sending signals and rewards to children and young people so that they become inclined to repeat behaviours that are appropriate. Modelling. Children learn some of their behaviours from others especially those around them. * Positive culture. Expectations adults have about children and their attitude towards them will influence their behaviour. * Looking for reasons for inappropriate behaviour and adapting responses. Understanding the needs of children and thinking about what might be influencing their behaviour is the heart of helping to promote positive behaviour. * Speech, language and communication difficulties. Childrenââ¬â¢s behaviour is linked to their language acquisition.Children who have difficulties expressing their needs or who are not using a language fluently often find it harder to manage their behaviour. * Individual behaviour planning, when a child is showing inappropriate behaviour a plan to manage it is drawn up. * Phased stages * Planning interventions to reduce inappropriate behaviour * Deescalate and diversion * Containment. This is about preventing children from getting themselves further in trouble. * Following management plans. Here every staff would follow the settings behaviour policy. Boundary setting and negotiation. Here the young children must know the boundary in the setting and what is expected of them. * Supporting children and young peopleââ¬â¢s reflection on and management of own behaviour 6. 1 Explain how t o support children and young people experiencing different types of transitions. Different types of transitions e. g. : * emotional, affected by personal experience e. g. bereavement, entering/ leaving care * physical e. g. moving to a new educational establishment, a new home/locality, from one activity to another * physiological e. . puberty, long term medical conditions * intellectual e. g. moving from pre school to primary to post primary When child go though transitions they need people they have built up positive relationships with to help support them through the changes in their lives. We use circle time to explain to the children what is going to happen and they can talk about their feelings children will make a better transition if they know what is going on. We take are cues from the children on how much information is given and how much an explanation is required.We allow time for the information to be processed some children might have delayed reaction and might want to talk later at a more quieter time. We are always to be truthful in all our answers so we keep their trust. We listen and acknowledge how the children are feeling and we reassure the children that what they are feeling is normal and other children have been through this. The children can express their anxieties and we can help reassure them. This covers emotional transitions like bereavement, physical moving homes or locality, physiological puberty, intellectual when moving up from pre school to school.
